Abuse that leaves no physical mark
Psychological and emotional abuse leaves no physical injury, so the psychiatric evidence is often the main evidence of harm. Dr Pradhan assesses the effect of coercive control, stalking, harassment, honour-based abuse and persistent emotional abuse in childhood, and gives an opinion on the diagnosis, its cause and its effect on relationships, work and daily life.
These cases often require careful analysis of social context, gender-related stigma and inconsistent disclosure across records. The report sets out a chronology of the conduct alleged and the claimant’s mental health, considers other explanations, and states the factual assumptions on which the opinion rests.
Dr Pradhan is a Fellow of the Royal College of Psychiatrists and is dual-accredited for claimant and defendant work.
The questions the report answers
The report deals first with the diagnosis, then with cause and treatment:
- Has the conduct caused a recognised psychiatric disorder, or distress short of one?
- How much of the claimant’s condition is due to the conduct, rather than other events in their life?
- What treatment is needed, and how long is recovery likely to take?
Whether the conduct happened as alleged is for the court. The report gives the psychiatric opinion on the factual basis in the instructions, and explains how it would change on other findings.

Submit an enquiryWhy the diagnosis matters to the claim
The route to damages decides what the psychiatric evidence must show. The report says plainly whether a recognised psychiatric disorder is present.
Harassment
Under the Protection from Harassment Act 1997, damages can be awarded for anxiety caused by the harassment, without a psychiatric diagnosis. Claims have a six-year time limit in England and Wales.
Intentionally causing harm
A claim for intentionally causing harm needs physical harm or a recognised psychiatric illness (Rhodes v OPO). The report addresses whether the illness is present.
Negligence
A claim in negligence against an organisation for mental harm generally needs a recognised psychiatric illness rather than ordinary distress.
Childhood abuse in Scotland
The Limitation (Childhood Abuse) (Scotland) Act 2017 removed the time bar for emotional abuse suffered as a child on or after 26 September 1964, as well as for sexual and physical abuse.
Psychological abuse in law and practice
In England and Wales, the Domestic Abuse Act 2021 includes controlling or coercive behaviour and psychological or emotional abuse in its definition of domestic abuse, and controlling or coercive behaviour in an intimate or family relationship is a criminal offence. Scotland and Northern Ireland have their own domestic abuse offences that cover a course of abusive behaviour.
For claims in England and Wales the report is structured for CPR Part 35 and Practice Direction 35. Reports for proceedings in Scotland and Northern Ireland are prepared to the requirements of those courts.
In a civil claim for harassment, damages may be awarded for any anxiety caused by the harassment and any financial loss resulting from it.

Call 0121 752 6065Is a psychiatric diagnosis needed for an emotional abuse claim?
It depends on the route. A harassment claim can recover damages for anxiety without one; claims in negligence or for intentionally causing harm generally need a recognised psychiatric illness. The report says whether one is present.
Can coercive control cause PTSD?
It can. Prolonged fear and control may lead to PTSD or complex PTSD, as well as depression and anxiety. The assessment examines the symptoms against the diagnostic criteria rather than assuming them.
The abuse was emotional abuse in childhood. Can the report deal with it?
Yes. The report considers the abuse alongside other adversity in the history and explains its effect on the claimant’s adult life.
There are few records of the abuse. Does that matter?
Psychological abuse often leaves few records. The report sets out the history given, the records that exist and the assumptions on which the opinion depends.
Does the 2026 change to limitation apply to emotional abuse?
Not in England and Wales. It covers only injury attributable to sexual abuse suffered under 18, so emotional abuse stays under the ordinary time limits and the court’s discretion, as all abuse does in Northern Ireland. In Scotland, the Limitation (Childhood Abuse) (Scotland) Act 2017 removed the time bar for emotional abuse suffered as a child on or after 26 September 1964.
How quickly can a report be delivered?
Usually 1–2 weeks from assessment, and urgent reports can often be provided in 2–5 working days where the papers and appointment can be arranged promptly.
