Psychiatric evidence for abuse and clinical negligence claims
Dr Pradhan acts as a psychiatric expert witness for solicitors who need precise evidence on how abuse or negligent healthcare has affected the claimant’s mental health. Her reports focus on the issues that matter in litigation: diagnosis, causation, apportionment, pre-existing vulnerability, prognosis, treatment and functional impact.
The psychiatric issues often go beyond symptoms alone. The central questions are usually whether the abuse or the negligent treatment caused the psychiatric condition, whether it materially worsened a pre-existing vulnerability, how long symptoms are likely to continue, and what treatment or support may reasonably be required. She considers the full psychiatric history, the chronology of symptoms, the medical records and the functional limitations, so the report deals with the questions in dispute rather than giving a general clinical summary.
Dr Pradhan is an APIL Tier 1 recommended expert and is dual-accredited for claimant and defendant work. She is regularly appointed as a single joint expert in contentious and higher-value matters, and judges have commended her reports for clarity.
What the report covers
Each report is written to the pleaded issues and the evidence available, whether the claim concerns a single traumatic event or years of symptoms with earlier vulnerability.
- PTSD, complex PTSD and adjustment disorder after abuse or traumatic medical events
- Causation, apportionment and prognosis in disputed psychiatric injury claims
- Depression, anxiety and panic symptoms
- Pre-existing vulnerability, and whether symptoms were triggered or made worse
- Historic abuse claims involving delayed disclosure and delayed-onset symptoms
- Psychiatric harm after alleged negligent treatment, delayed diagnosis or a traumatic healthcare experience
- Treatment recommendations, recovery timescales and future psychiatric risk
- Chronic pain with psychiatric overlap and somatic symptom disorder
- Functional impact on employment, relationships, sleep, confidence and daily living
- Competing explanations and other adversity in the history
- Claimant and defendant instructions, including SJE appointments
- Joint statements, supplementary reports and second opinion instructions
If your instruction raises a question not listed here, send a short summary and Dr Pradhan will confirm whether it falls within her expertise.
Submit an enquiryThe three questions solicitors need answered
Dr Pradhan assesses whether the claimant meets the diagnostic criteria for PTSD, complex PTSD, a depressive or anxiety disorder or adjustment disorder, and the report deals directly with:
- Did the abuse or the negligent treatment cause the psychiatric condition?
- Did it materially worsen an existing condition or vulnerability?
- What is the likely course of recovery, and what treatment is reasonably required?
That analysis is central to causation, apportionment and prognosis, and to a reliable view on quantum.

Evidence for the value of the claim
Psychiatric injury is valued by its effect on the person’s life, not by the diagnosis alone. In England and Wales, the Judicial College Guidelines look at matters such as the injured person’s ability to cope with life, education and work, the effect on their relationships, how far treatment is likely to help, future vulnerability and the prognosis. Dr Pradhan’s reports give the psychiatric evidence on each of them, so that the valuation rests on reasoned opinion rather than a label. Northern Ireland has its own Green Book guidelines.
In more complex work the psychiatric picture is often not limited to a single trauma diagnosis. She is instructed in cases involving chronic pain, medically unexplained symptoms, somatic symptom disorder and the psychiatric consequences of serious physical harm, including harm after negligent treatment.
Conditions commonly assessed
- PTSD and complex PTSD

Independent, court-ready reports
Expert evidence must be independent, reasoned and suitable for court use. For claims in England and Wales, reports are structured for CPR Part 35 and Practice Direction 35, including the statement of the expert’s duty to the court and the statement of truth. Reports for proceedings in Scotland and Northern Ireland are prepared to the requirements of those courts.
Diagnoses are made under ICD-11 or DSM-5-TR, and the report states which classification is used. Whether abuse took place, and whether care outside psychiatry fell below the required standard, are matters for the court and for experts in the relevant field. Where the claim concerns psychiatric care itself, see psychiatric breach of duty reports.
An expert’s duty is to help the court on matters within their expertise. It overrides any obligation to the person who instructs or pays them.

Questions solicitors ask
If your question is not answered here, call or send the case details and Dr Pradhan will advise.
Call 0121 752 6065Does Dr Pradhan act for claimant and defendant solicitors?
Yes. She is dual-accredited and regularly prepares psychiatric injury reports for claimant and defendant solicitors. She is also appointed as a single joint expert where the parties agree, or the court directs, that one expert should report for both sides.
How quickly can a psychiatric injury report be delivered?
Usually 1–2 weeks from assessment. If the deadline is tighter, an urgent report can often be provided within 2–5 working days, where the papers and appointment can be arranged promptly.
What issues do the reports address?
Diagnosis, causation, apportionment, pre-existing vulnerability, prognosis, treatment needs and day-to-day functional impact, in conditions such as PTSD, complex PTSD, depression, anxiety, adjustment disorder, chronic pain-related presentations and somatic symptom disorder.
Does the report decide whether the abuse happened or the care was negligent?
No. Those are findings for the court. The report sets out the history given, the records reviewed and the factual assumptions on which the psychiatric opinion depends, and where accounts conflict, it explains how the opinion would differ.
What are the fees and payment terms?
Dr Pradhan works on a fixed fee basis with no hidden charges, and flexible and deferred payment terms are available in suitable cases. Legal aid (LAA), CFA or insurance-backed, private, and council, court or CPS-funded instructions are accepted. For a fee quote, send the case details through the enquiry form.
Can claimants be assessed outside Birmingham?
Yes. Claimants can be assessed at any UK location where appropriate. Instructions are accepted from solicitors across England, Wales, Scotland and Northern Ireland, and worldwide.
